About these terms

These Terms of Service apply to the YAY Real Estate website and any connected social media account, content preparation or publishing function operated by YAY Real Estate. YAY Real Estate is the trading name of Yay Trading Pty Ltd (ABN 86 617 735 323), a licensed NSW real estate corporation (Corporation Licence 10094864). By using the website or authorising a connected service, you agree to these terms and our Privacy Policy.

Website information

Website content is provided for general information and marketing purposes. Property descriptions, availability, prices, market commentary and other information may change and should be independently verified before you rely on them. Nothing on this website is legal, financial, taxation or investment advice.

Enquiries and real estate services

Submitting an enquiry, appraisal request or subscription does not create an agency, tenancy, fiduciary or other professional relationship. Any real estate service is subject to separate written agreements, applicable law and the terms agreed with the relevant client, owner, tenant, purchaser or supplier.

Connected social media services

YAY Real Estate may use an internal, access-controlled service to connect its own Facebook, Instagram, LinkedIn, YouTube and TikTok accounts. The service uses permissions granted by an authorised account holder to verify the intended business account, retrieve the limited account capabilities and publishing settings required by the platform, publish content approved by YAY Real Estate, and check publication status.

Only an authorised representative may connect, disconnect or instruct the service. The representative must have authority to act for the relevant account and must ensure that submitted content, music, images, video, captions, claims and other materials are accurate, lawful, appropriately licensed and approved for publication.

Platform-specific conditions

Connected services remain subject to the applicable terms, policies, technical requirements, availability and account controls of Meta, LinkedIn, Google/YouTube and TikTok. Those platforms may restrict permissions, change APIs, review content, delay processing, alter privacy options, suspend access or remove content. YAY Real Estate does not control those platform decisions.

Google and YouTube connections use Google OAuth and YouTube Data API permissions granted by the account holder. TikTok connections use TikTok Login Kit and the Content Posting API. Meta and LinkedIn connections use their respective account permissions and APIs. Connecting an account does not enable public publishing unless YAY Real Estate has separately enabled the relevant internal publishing control.

Content and intellectual property

Unless stated otherwise, the website design, YAY branding and original content are owned by or licensed to YAY Real Estate. You may view and share public pages for personal, non-commercial purposes, but you must not copy, modify, scrape, republish or commercially exploit them without permission. Third-party trademarks and platform names remain the property of their respective owners.

Prohibited use

You must not misuse the website or connected services, attempt unauthorised access, interfere with security controls, introduce malicious code, submit unlawful or misleading material, impersonate another person, infringe intellectual property or privacy rights, or use the services in breach of any platform rule or applicable law.

Availability and changes

We may maintain, modify, suspend or discontinue any website or connected-service function where reasonably necessary for security, compliance, platform changes or business operations. We do not guarantee continuous or error-free availability. We may update these terms by publishing the revised version and updated date on this page.

Disconnecting a platform account

An authorised account holder may revoke platform access using the relevant platform’s account settings or request disconnection by contacting info@yayrealestate.com.au. Disconnecting does not automatically delete content already published on a third-party platform.

Liability

To the maximum extent permitted by law, YAY Real Estate excludes warranties not expressly stated and is not liable for indirect or consequential loss arising from website use, third-party platforms, interruptions or information that should have been independently verified. Nothing in these terms excludes rights or remedies that cannot lawfully be excluded, including applicable rights under the Australian Consumer Law.

Governing law

These terms are governed by the laws of New South Wales, Australia. The parties submit to the non-exclusive jurisdiction of the courts of New South Wales and courts entitled to hear appeals from them.
